Application

  1. These Terms and Conditions apply to the purchase of the goods by you (the "Customer" or "you") from Frazermore LLP of 31 Wellington Road, Nantwich, Cheshire CW5 7ED, trading from Unit 35 St Patricks Place, Stafford, Staffordshire ST16 2PN (the "Supplier", "we" or "us").   2. By ordering any Goods from our Website, you agree to be bound by these Terms and Conditions. You will be required to accept these Terms before completing your order by clicking the "I Accept" button.

Interpretation

  1. Consumer: an individual acting outside their trade, business, craft, or profession.
  2. Contract: legally-binding agreement between you and us.
  3. Delivery Location: the Supplier’s premises or other specified location.
  4. Durable Medium: paper or electronic means that can be stored for future reference.
  5. Goods: items listed on our Website to be supplied to you.
  6. Order: the Customer’s request for Goods via the Website.
  7. Privacy Policy: how we handle your personal data.

Goods

  1. The description of the Goods is listed on our Website or other marketing material. Slight discrepancies in size or colour may occur.
  2. It is your responsibility to ensure all custom specifications are accurate.
  3. Goods are subject to availability.
  4. We may make changes to comply with legal or safety standards and will inform you accordingly.

Personal Information and Registration

  1. You must keep your username and password confidential.
  2. We use your information in accordance with our Privacy Policy.
  3. You consent to receiving communications via email, post, or electronic means.

Basis of Sale

  1. Website listings are not an offer of sale; we may reject your Order.
  2. You are responsible for correctly completing the order process.
  3. The Contract is formed when you receive our Order Confirmation email.
  4. Quotations are valid for 7 days unless withdrawn earlier.
  5. Contract changes must be agreed upon in writing.
  6. If you are not a Consumer, please inform us for a more suitable agreement.

Price and Payment

  1. Prices are as shown on the Website or agreed upon in writing.
  2. All prices include VAT.
  3. Payment is required at checkout by credit/debit card.

Delivery

  1. We aim to deliver within 30 days unless otherwise agreed.
  2. If we fail to deliver on time and time is essential, you may treat the Contract as ended.
  3. In such cases, we will return all payments promptly.
  4. You may also cancel the Order or reject Goods and we will collect them at our cost.
  5. If Goods form a commercial unit, you cannot cancel/reject only part of them.
  6. We do not typically deliver outside the UK. Import duties may apply.
  7. We may deliver in instalments.
  8. If you fail to take delivery, we may charge reasonable storage/redelivery costs.
  9. You become responsible for the Goods once delivered or collected.

Risk and Title

  1. Risk passes upon delivery.
  2. Ownership passes only after full payment. We may reclaim unpaid Goods.

Withdrawal and Cancellation

  1. You may withdraw your Order before the Contract is formed.
  2. You may cancel the Contract within 14 days unless the Goods were custom-made. You must return the Goods in good condition at your own cost.
  3. Certain Goods (e.g., custom or perishable) are exempt from cancellation rights.
  4. Cancellation rights end if the Goods become inseparably mixed.

Right to Cancel

  1. You can cancel this Contract within 14 days without reason.
  2. This period begins when you or a third party receives the Goods.
  3. You must notify us of your decision clearly by post or email.
  4. We will confirm receipt of cancellation.
  5. Sending your cancellation before the deadline is sufficient.

Effects of Cancellation

  1. We will refund all payments including delivery (except premium options).

Deduction for Goods Supplied

  1. We may deduct for diminished value due to excessive handling.

Timing of Reimbursement

  1. We will refund within 14 days of receiving the returned Goods or proof of posting.
  2. If no Goods were supplied, we refund within 14 days of cancellation notice.
  3. We use the same payment method for refund unless agreed otherwise.

Returning Goods

  1. Goods must be returned to 31 Wellington Road, Nantwich, Cheshire CW5 7ED within 14 days. Return costs are your responsibility.

Definitions

  1. Distance Contract: Agreement made without face-to-face interaction.
  2. Sales Contract: Agreement involving goods and possibly services for payment.

Conformity

  1. We must supply Goods that conform to the Contract.
  2. Goods must:
    • Be of satisfactory quality,
    • Be fit for their intended purpose,
    • Match their description.
  3. Failure to conform due to your input is not our responsibility.
  4. We provide after-sales service: support during property sale and buyer fee collection.

Successors and Sub-Contractors

  1. Either party may transfer Contract benefits; obligations remain.
  2. We are responsible for sub-contractors.

Events Beyond Our Control

  1. We will inform you of any uncontrollable events and suspend obligations accordingly.

Privacy

  1. We comply with GDPR and respect your privacy.
  2. Refer to our Privacy Policy and Cookies Policy.
  3. Definitions follow the GDPR.
  4. We are a Data Controller of your personal data.
  5. We:
    • State data collection purposes,
    • Process only as needed,
    • Respect your rights,
    • Use secure data practices.

Excluding Liability

  1. We do not exclude liability for fraud, negligence, or death. We are not liable for unforeseeable or business losses.

Governing Law, Jurisdiction and Complaints

  1. This Contract is governed by the laws of England and Wales.
  2. Disputes may be resolved in courts of England, Wales, Scotland, or Northern Ireland.
  3. If you have a complaint, contact us and we aim to resolve it within 7 days.
